Know Your Rights

From the Fall 2010 Newsletter of the Utah Association of Criminal Defense Lawyers:

"In Washington County, investigator David Doddridge was instrumental in getting federal drug and gun charges dismissed. The defendant was facing charges for operating a marijuana farm. Federal prosecutors threatened him several times with 10 years if he didn’t take a two-year plea. David and his associates re-interviewed the witnesses in both Utah and Wyoming and found that their statements did not substantiate the police report. Other witnesses nullified the “knowledge and accessibility” elements required for the gun prosecution. Further, the investigators established that five out of six statements in the search warrant affidavit were unreliable. These statements served the foundation for a Franks motion. As to the marijuana charge, David developed a timeline and photographs to show the grow operation could not have been in use when the government claimed it had been. The defense team turned over all of this information to the prosecutor who subsequently dismissed all charges."
